The bill announced today by Sen. Van Wanggaard, R-Racine, and Reps. Dana Wachs, D-Eau Claire, Ron Tusler, R-Harrison, and Shannon Zimmerman, R-River Falls, would prohibit drivers from using an electronic device to “enter, transmit or access data” while driving.
1. Increases the scope of cell phone use prohibited while driving.
2. Increases the minimum fine for using a cell phone for reasons other than making a voice or hands free voice call to $100 to $400. Under current law the minimum penalty is $20.
3. Explicitly states in statute that a violation of this law, Wis. Stat. s. 346.89(3)(a) which causes death may be charged as Homicide by negligent operation of vehicle under Wis. Stat. s. 940.10.
